Digital Artist Disclaimer

Description

Because eeeverybody else covers their gluteus maximus except us.

This is a digital artist's disclaimer image I created, due to the fact that
individuals can, have, will, and do make choices to fraudulently and illegally
upload/publish/offer stock images (and also, the website venues that
host/display/offer them), for us to choose from to legally create our artworks,
for which they, the individual/website/entity, had/have no legal standing or
right to do so, because it was/is not their property. They, some individuals
and all website venues that I have seen offering stock, nearly all conveniently
opt out of obligation and potential legal ramification through their own Terms
Of Service and/or Disclaimer.
Who is completely and potentially, "left holding the bag", legally? The artist.
I choose to do stuff like take a person's word as their bond, including persons
that create and run online venues... you know, THE TRUTH, and stuff like that,
and refuse to be penalized for it... but that does not mean anything in a court
of law where you may have inadvertently put yourself squarely in the line of
fire to be liable for the wrong-doing of somebody else. So, through the use of
this disclaimer, I will never ever pay for somebody else's bone-headed-ness and
be held liable in any way for just doing what I am supposed to be doing, legally,
operating within copyright law, according to an individual's or a venue's own
specified terms of use for stock images.

Yowza, 'nuff said, right?

Stock use in this creation? Public Domain Pictures Dot Net.

Final appearance and all else created with Jasc Paint Shop Pro.

You want to use this image itself, or it's wording, or it's concept?
Absolutely, have at it, be my guest, yes.

* This disclaimer's disclaimer: I do not pretend to be a lawyer, and this does
not constitute legal advice. I have just identified a potential problem for
digital artists and am expressing my opinion as to how to covers one's own self
against financial damages, etc. When in doubt, seek legal advice for yourself. :)

Well done Mike, I want to thank you for taking the time to put a voice to how I've been feeling for some time now. Frankly, I'm tired of "The Artists" carrying the full burden when it comes to the legalities of stock usage. I can't stop the illegal use of stock nor can I make other stock users give proper credit, but I am tired of paying the price for these abuses. I don't want to throw in the towel, as far as making photomanipulations, but I am tired of fighting the war and just want peace. Thanks for your help in composing a fantastic disclaimer that I would be honored to display, giving you proper credit, of course.Clap Nod
