ADOPT - COMISSION T.O.S / RULES

THIS NEW T.O.S WILL APPLY TO MY FUTURE AND PAST ADOPTS, COMMISSIONS AND BASES.
I WILL UPDATE IT, IF I CHANGE SOMETHING.


ADOPTS

Payments and reselling

- I accept payment only in Paypal ( Either USD or EURO ) or sometimes in dA Points.

- After winning adopt you have 24 hours to finish a payment. If you fail to do this, the adopt will  go to the next bidder, UNLESS we have talked about it, to make the time longer.

- Ask about holds, if its not stated on the adopt info. If you need hold, please, let me know!

- If you have a Payment plan, they have to be finished within the time range we have planned and agreed with.
The adopt will be yours only when the payment has been completed!


- _Any portion of paid payment plans wont be refunded if you can not finish the plan!_

- Do not send me money unless I've accepted your offer!

- Do not ever commission the character before it's fully paid.

- Always wait for my reply before sending me any money / points. I will tell you when to pay.

- If you wish to pay with points, there will be 2 weeks waiting time for reselling the adopt, IF paid via commission widged. Paying via ''Gift / Donation'', this rule will not apply.

- The payment  must always be sent first, Only after reciving the payment I will send you the drawing.
You will receive a digital full sized file of the character. This product requires no physical shipping to any physical address.

- There will be no refunds. / Refunds are not allowed.

- You can resell the character same or lower price. If you have been getting art to the adopt, you may add the value of extra art to it. Ex, All extra art what you have _commissioned_ can be added to the price, BUT free art/trades/art drawn by you can not be added to the price when resold! In any case selling it higher price, with no extra art, IS NOT ALLOWED.
Do tell me the new owner in this case!

- To protect myself, I do not accept offers from users who have had their account less than 1 month / Unless have older account here or twitter ;;

- You can also gift/trade it.
Do tell me the new owner is this case!

- You can ONLY RESELL IF YOU HAVE _BOUGHT_ THE ADOPT FROM ME-
 Traded / gifted adopts can _NOT_ be resold only traded or gifted!

- When adopt changes owner let me know, as said earlier.

- Write banaani in your adopt comment if you have read the adopts rules when you're byuing adopt from me.
This way I know that you have read the rules.

- Please, do not complain about my adopt prices. And please, keep the self pity to yourself. Im sorry, but I dont want to hear everytime I post adopts the famous, '' I wish that I had money to buy this, but im so poor, and my leg is broken, and my dog just died, can I have it for free?''.

Commercial work

---

- You may use the design for commercial work (novels/stories, not visual novels) with a proper credit for me (link to my dA page).
For products for sale (charms, visual novels, comics, t-shirts etc.) you need to pay extra +20% of the adopt price. Credit isn't mandatory when paid the extra price but do not claim that the design is made by you, you just do not have to extra mention me anywhere unless someone asks.
You can not sell my drawn work, you have to draw the design yourself or have other artist to draw it for you. Directly my art can not be resold as different product.

Adopt bidding/claiming

---

- You can NOT bid on my adopts with an account less older than 3 months UNLESS you have proof that you have purchased other adopts before.
- No dropping out or hiding comments after bidding. If I find out about it, you will get slight ban
( To 1 month --> ).
If you cannot pay the amount you have bidded, send me a note, and I will hide it.
 
- Refunding is again not accepted. If you're not happy with your adopt anymore, you're good to go and sell it the same amount what you paid for it.

- Be 100% sure that you can pay.

- Failed payment or hidden comments will lead you to my blacklist or a timed suspending from my adopts.

- Mystery adopts will never be refunded.
You can resell them with same price you bought them for. (check my resell rules above)

Adopt etiquette 

- Do not steal, trace or copy
- IF YOU ARE INSPIRED BY MY ADOPTS Please give me some kind of credit, so people wont lose their shits. And it is just nice thing to do.
-  Credit me the first times when you upload my design adopts to Toyhou.se/dA (it's Piannen @ TH), stash etc.
 Do not repost my art on dA or other social sites beside TH without my permission or at least tag/credit.

- Never claim my ART as your own!

Closed Species


---

-  READ the rules for specific adopt. Sometimes I might have extra notices you must know, especially about closed species.

- If I have forgotten to mention about something here do not automatically assume that it is okay. Always ask if you are not sure about the rules! I dont bite, I appreciate it.

-  You can NOT sell your MYO creations unless otherwise mentioned, proof of me saying so must be provided.

- You can trade/gift your ready MYO's and MYO tickets but let me know!

- You can always change my closed species into NON species. It is fully up to you want to use my adopts, once it's bought its yours. I would like to know if you change them to non species adopts in case I do species related events etc. so your character wont be included.

- Never start any drama or accusations in species groups. All sensitive topics, complaints etc. MUST come to me directly via NOTE. If you are too problematic to everyone I do have the rights to kick you out of the group. You will keep your rights, but I'm done with all the drama.

COMMISSIONS


---


- MY Commissions are NOT first come first serve

I will pick the ones what I want to do. I dont want to do art of characters what I dont feel bond it, because the quality of the art piece will drop. I want to have motivation, and inspiration when I'm doing commissions.
I dont mean this in the bad way. I just want to have fun doing my job.

- Only me and the client has the rights to use the artwork what I make.

- If you are a blacklisted from my species, adopts, you're BANNED from my commissions too.

- Styles might change

I'm usually rolling around with my style, so it might not be completely same all the time. I'm learning new, trying out new things. This might have effect on the result on your commission.
If I will dramatically change my style, you will be noted via dA notes about it, where I ask if its alright to you.


- If paid with points you have to wait 2 weeks until I will start your commission via widged.

I'm not risking any scam nor ban from dA points so I will only start after I can cash out the points to my paypal.

- If you want to place an order Note me!

I highly prefer you sending me a note, not commenting about your commissions. I will find the information what I need easier this way.

- No poor quality references of your character or text as a reference

If you don't have any good reference of your character already I can not accept your commission, unless it is a custom adopt / design. Please make sure if your character is anything else than clear cell shaded I might not get the colors 100% accurate. To keep these things from happening make sure you have color palette reference of your character as well. 

- No refund or returning your money. (Asked by you)

There is no refunding when you have send your payment to me for commissions.
Only in special cases, where you just have been paid and something really dramatic comes up, I can refund you.
But that is only in rare cases.

If you absolutely hate the final product and I failed to produce your character looks at least 80% different than its suppose to, you can ask me to draw it again. This has never happened and I do keep close look into the details. Please notice that very complex OC's can have changes due;
1. Them being too small to notice
2. Them being too complicated for me to draw
3. Too messy reference to begin with.
4. Be specific of things that your OC has that DO MATTER to you. (example: ''My OC has curly hair instead of straight even if these other commissioned pieces look more like straight hair than curly. So please draw it curly like this -example picture-!'')

- Write persikka in your adopt comment if you have read the adopts rules when you're commissioning me from me.
This way I know that you have read the rules.

I wont refund if I deliver your a drawing what is perfect in my option, but you need money and want a refund etc.

- I will refund IF your character gives me an art block / something personal happens.
  
- Credits are needed if you upload it to anywhere ex. Toyhou.se, dA, FA or Tumblr

Always upload a version with my or your watermark on it and credit me for my art.

- Commission delivery

I am slow doing commissions. If you're to commission me, you AGREE to wait atleast 1 ( one ) month until sending me messages about it. I will always do what I have promised, but I am just super slow.
If you dont hear about your commission + one month you can send me note about it.
I might have forgotten.
But love of god, be patient. I will usually go trough your history with things, and if you seem not patient enough, I might refuse your commission.

- WIP pictures can be asked only when doing customs / paintings.

You can ask work in progress pictures at any moment but please understand that I have my own projects and other peoples commissions and I wont be working on your commission every day. I very rarely send WIP's unless they are being asked.

- Digital commissions

All my work is digital. I do not offer any physical products. Adopts will be delivered to you as seen on example picture (often in their original form or slightly smaller size). Commissions have examples but your character will look always slightly different from example due some characters being more or less appealing to you. Your commission wont ever look exactly (100%) the same than examples, it's art, it's not copy pasting. (Example of same style but different characters difference: fav.me/darlzf3 remove the space)

BASES


---

- The payment is always non refundable after I have send you the files.
- Reselling my bases, or their parts are NOT allowed.

- Do not send me money before I tell you to!

- You can edit my bases how ever you wish. But no matter how much you have edited it, you CANNOT sell it.
- Designs made on my base can be sold for any price, and in any way. So auctions, flat rates, raffles, adopts etc.
- Dot NOT profit from this in any other way, or send the .PSD, .PNG .SAI or any other blank bases to anyone! Making it as an YCH is also not allowed! ( Ex. selling the base, drawing others characters to the base, with out adding something new. )
- When using my bases, Always credit me with : iconpiannen : or @ / Piannen . In other websides, link back to my dA profile.
- Do not claim that you're creator of the base.
- Write ''mustikka'' in your comment when you're paying for the base.
This way I know that you have read the rules.
- You can use my bases in your species refsheets. Just remember to credit me.

PAYMENTS

-  When adopt/commission is paid with Paypal, IN USD OR EURO. I will send you an INVOICE to pay, when the amount goes over 25$

- I do NOT accept eChecks!

- Payment has to be delivered within 24 hours from winning the adopt / commissioning me (unless hold)
-  If you need hold or payment plan for your adopt purchase you have to mention about it when you're bidding, and we will further discuss about it via notes. Remember to check if the hold / payment plan is accepted on said adopt.
- When paying with points I will tell you further how to deliver the points, do NOT just ''gift'' them unless I say so.
- 1$ = 100
- In every case, payment must be sent first. I will not send, nor start doing anything before I get the payment. If you dont trust me with sending the money first, then honestly, too bad.




 VIOLATIONS OF THESE TERMS WILL RESULT FIRST IN WARNING, and if issue is not resolved, in being blocked and permanently banned for participating any of my future adopts, bases, commissions etc.


I HAVE EVERY RIGHT TO DENY YOUR ORDERS IN ANY CASES.
I will not do commissions or sell my adopts to people who have been on deviantart less than 3 months, unless you have proof that you have been here longer.
I can also only take points / paypal from some customers.
